1. Who we are
AIXHORN S.A.S. ("AIXHORN," "we," "us," or "our") is a company organized under the laws of Colombia, with its principal place of business in Medellín, Colombia. AIXHORN owns and operates rödea (the "Website"), reachable at rodeacare.com, and the rödea application. rödea is a standalone brand of AIXHORN S.A.S. and is not affiliated with any other company that may have previously used a similar name.
2. Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of the Website, including browsing its content and starting a checkout. By using the Website or submitting the checkout form, you agree to be bound by these Terms. If you do not agree, do not use the Website.
3. The Website is informational
The Website describes rödea and lets you start onboarding. rödea is not a medical device and is not intended to diagnose, treat, or monitor any medical condition. Content on the Website is for general informational and general-wellness purposes only and does not replace medical advice or evaluation. Always consult a qualified healthcare professional for medical decisions.
4. Checkout and Onboarding
The checkout lets a buyer select a membership plan, optionally apply a discount code, and designate the email of the person who will administer the resulting care group (the "administrator"). The buyer and administrator may be different people. We send the administrator a one-time invitation; activating it is a separate acceptance of the Application Terms of Service and Application Data Policy, independent of the buyer's acceptance of these Terms.
Plans have a defined duration and, where applicable, a price and currency shown at checkout. Promotional codes are subject to the eligibility rules and expiration communicated when they are offered, and may be limited to specific countries or time periods.
5. Payment and Billing
Where a plan has an associated price, the administrator's access to paid features activates once payment has been confirmed. We may suspend access to paid features if payment cannot be verified.
6. Acceptable Use
You agree not to: (a) use the Website for any unlawful purpose; (b) attempt to gain unauthorized access to accounts or systems; (c) submit false or fraudulent checkout information; or (d) interfere with the normal operation of the Website.
7. Intellectual Property
The rödea name and logo, and the Website's software and content, are the property of AIXHORN S.A.S. and its licensors. These Terms do not grant you any rights to our trademarks or branding beyond what is necessary to use the Website as intended.
8. Disclaimers and Limitation of Liability
The Website is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, AIXHORN S.A.S. is not liable for indirect, incidental, or consequential damages arising from use of the Website.
9. Governing Law and Disputes
These Terms are governed exclusively by the laws of the Republic of Colombia. rödea currently operates only in Colombia. Any dispute arising from or relating to these Terms or your use of the Website will be submitted to the competent courts of Medellín, Colombia, whose jurisdiction you accept by using the Website.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
